The debate about whether Ethereum (ETH) is a safety is warm again, and this time an American legislator is coming. The American representative William Timmons from South Carolina urges the Securities and Exchange Commission (SEC) to release internal documents that explain his changing position on the legal status of Ethereum over the years.
Ask for internal documents from Ethereum
In Letter to SEC CHer Paul AtkinsTimmons expressed his concern about what he described as the “zigzagging” behavior of the sec when it comes to ETH. He noted that public and crypto market participants deserve transparency, especially after years of mixed signals from the agency.
To achieve it up to the bottom, Timmons has asked to ask for important internal documents from the SEC. These include:
- E -mails that discuss Ethereum and whether it is eligible as a security
- Records about the ETH 2.0 research
- Files entitled “ETH – Security or not” and similar topics
These documents were previously identified in a lawsuit involving Coinbase, but were not publicly shared.
2018 Promise, 2025 Confusion
In 2018, the SECs director of Corporate Finance, William Hinman, stated that ether and bitcoin would not be treated as effects. Because of this, people in the crypto community felt safer.
But among chairman Gary Genler and the Biden administration, the rules seem less clear because they refused to offer more clarity about their security status.

In the meantime, Timmons pointed out that this confusion is bad for companies and for ordinary people who are interested in crypto. He said: “The American people and the crypto community deserve transparency while the congress continues with the Clarity Act.”
Why does it matter?
Timmons says that releasing these records the congress, the crypto industry and the public will help understand how the view of the SEC on Ethereum has changed. He also believes that this light will shed on what he calls the SEC strategy of the ‘Regulation by Enforcement’ strategy -one that has delayed innovation and confused investors.
